Terms of Service

Protect My Face is provided by Sundial Mirage, Inc. (“Sundial,” “we,” “us,” or “our”). By creating an account or using Protect My Face (the “Service”), you agree to these Terms.

1. What Protect My Face Does

Protect My Face helps you monitor where your likeness may appear online. When you use the Service, you can:

  • upload photos to enroll your face;
  • receive alerts about possible matches found online;
  • review supporting details (like source links, screenshots, and confidence scores); and
  • organize or initiate takedown requests where appropriate.

Important: The Service is a tool to help you identify and respond to potential uses of your likeness. It is not a guarantee that all uses will be found, correctly identified, or removed.

2. Who Can Use the Service

You must be an adult (age of majority in your location) to use Protect My Face.

You may not:

  • enroll another person; or
  • upload images of another person.

You are responsible for ensuring you have the right to act on behalf of any person you enroll.

3. Your Account

You agree to:

  • provide accurate information;
  • keep your login credentials secure; and
  • be responsible for all activity under your account.

If you suspect unauthorized use, notify us immediately.

4. Photos You Upload

You may only upload photos of yourself. By uploading photos, you confirm that:

  • you have the legal right to use and share them; and
  • their use in the Service will not violate any laws or third-party rights.

5. How Your Photos Are Used

You can close your account or request deletion of your uploaded photos at any time.

To provide the Service, we use the photos you upload to:

  • analyze facial features and generate a mathematical facial signature used for matching;
  • compare that signature against images found online;
  • identify and provide you with possible matches; and
  • improve the accuracy, safety, and performance of the Service.

We retain the images you upload as part of your account so that we can:

  • support and facilitate legal takedown requests (such as the federal TAKE IT DOWN Act and the DMCA);
  • maintain and refine your facial signature over time;
  • re-run or improve matching as our systems evolve; and
  • support your monitoring history and related features.

The Service is designed to use mathematical representations for matching rather than reconstructing or redistributing your face from those representations. We store your photos in a secure environment and limit access to what is necessary to operate the Service.

We retain your uploaded photos for the duration of your active account. Upon account deletion or a valid deletion request, we will delete your photos within a reasonable timeframe, subject to any legal obligations or legitimate operational needs (such as fraud prevention, dispute resolution, or compliance).

The Service involves the processing of biometric data derived from your uploaded images. By using the Service, you agree to the collection and use of such data as described in our Biometric Data Policy.

6. Accuracy and Limitations

Protect My Face uses automated systems and evolving technologies. As a result:

  • some matches may be missed;
  • some results may be incorrect (false positives);
  • confidence scores are estimates, not certainties; and
  • not all parts of the internet are accessible to our systems.

Content may also change or disappear before you review it.

You should independently review any flagged content before taking action.

7. Takedowns and Legal Notices

The Service may help you prepare or organize takedown requests, but:

  • Sundial is not a law firm and does not provide legal advice;
  • we do not guarantee that any content will be removed; and
  • we do not guarantee that any notice meets legal requirements in every jurisdiction.

You are responsible for:

  • ensuring your claims are accurate and made in good faith; and
  • complying with applicable laws when submitting notices.

We may require identity verification or supporting documentation before enabling certain actions.

8. Acceptable Use

You may not use the Service to:

  • monitor or track someone without proper authority;
  • harass, stalk, intimidate, or harm others;
  • upload images you do not have the right to use;
  • submit false or misleading takedown requests; or
  • misuse the Service for unlawful purposes.

We may suspend or terminate accounts that violate these rules.

Rate Limits and Abuse Prevention

To protect the integrity, availability, and fair use of the Service, we may impose reasonable usage limits, including limits on:

  • the number of images you upload;
  • the frequency or volume of uploads;
  • the number of takedown requests you initiate within a given period; and
  • other actions that may place excessive load on the Service or indicate misuse.

If we determine, in our sole discretion, that your use exceeds these limits or constitutes abuse (including attempts to upload large volumes of images or submit excessive takedown requests), we may:

  • temporarily restrict functionality;
  • suspend your account; or
  • terminate your account.

We may take these actions with or without prior notice where necessary to protect the Service or other users.

9. Third-Party Platforms

The Service may point you to content hosted on third-party websites or platforms.

We do not control those platforms and are not responsible for:

  • their content;
  • their policies; or
  • their response (or lack of response) to takedown requests.

10. Subscriptions and Payments

Some features may require a paid subscription.

By subscribing, you agree that:

  • fees will be charged as disclosed at purchase;
  • subscriptions renew automatically unless canceled before renewal; and
  • fees are generally non-refundable unless required by law.

You can manage or cancel your subscription through your account.

11. Changes to the Service

We may update, modify, or discontinue parts of the Service at any time.

We may also update these Terms. If we make significant changes, we’ll provide notice.

12. Disclaimer of Warranties

Protect My Face is provided “as is” and “as available.”

We do not guarantee that the Service will:

  • find every instance of your likeness;
  • correctly identify all matches; or
  • result in successful takedowns.

13. Limitation of Liability

To the fullest extent permitted by law:

Sundial will not be liable for indirect or consequential damages, including loss of reputation, emotional distress, or lost opportunities.

Our total liability for any claim related to the Service is limited to the amount you paid us in the past 12 months (or $100, whichever is greater).

14. Your Responsibility and Indemnity

You agree to take responsibility for your use of the Service.

You will indemnify and hold Sundial harmless from claims arising from:

  • your uploaded content;
  • your misuse of the Service; or
  • any takedown requests you submit.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, except where local consumer protection laws apply.
